The following terms and conditions apply to all bookings. Please contact us if you have any questions regarding the booking terms.

MORZINE- CHALET.COM

Morzine-chalet.com manage and operate Chalet Cecile and Chalet Moraine in Morzine. The managers Joseph & Amelia Pearson have lived in Morzine year round since 2012. They strive to provide all clients with a stress-free and enjoyable holiday experience.

BOOKING CONTRACT

After your enquiry, a booking must be confirmed in writing by completing the booking form and submitting it to the info@morzine-chalet.com email address. Upon receipt of the completed booking form and payment of the booking deposit (as detailed below) a confirmation of booking will be sent via email. When the booking confirmation has been sent, a contract will be deemed to exist between Morzine-chalet.com and the sender of the booking form whom confirms that he/she is the group leader and is responsible, on behalf of all other members of the group, for all matters relating to the booking. Once the booking contract comes into existence, Morzine-chalet.com undertake to maintain the agreed cost of the holiday.

PAYMENTS

Morzine-chalet.com accept Visa (credit or debit) and MasterCard and do not charge any credit card commission fees. All monies are debited in euros so check with your bank regarding transaction fees. If you do not wish to pay by credit card we will accept UK sterling bank transfer, please just ask and we will let you know the price in sterling & bank details. We also accept euro bank transfers.

Deposits:

Upon booking, a deposit of 25% becomes payable prior to the acceptance of the booking and the inception of the booking contract. The final balance outstanding on your holiday is due 8 weeks before the beginning of the holiday. If you are booking closer than 8 weeks to the start of your holiday, the full amount is payable immediately.

If the final balance is not received 8 weeks before the start date of your holiday with Morzine-chalet.com, we reserve the right to cancel the booking and retain the deposit paid and levy cancellation charges as outlined below. Morzine-chalet.com then reserve the right to re-book the same week in the same accommodation to another client.

Where a price is quoted in Sterling (£GBP), any payments taken on Visa or MasterCard will be processed in €Euros using the

exchange rate taken from www.xe.com on the day of payment. Please note that not all card issuers use this same exchange rate and we have no liability for any difference in costs resulting from different exchange rates being applied to the payment.

A good house keeping bond of €1000 is required on your arrival; this can be paid with a pre authorised credit card or by cash in resort and will act as security against damage, loss, breakages and additional cleaning charges.

PRICES

The prices quoted on the website are for one week’s (7 nights) accommodation on a self-catered basis unless otherwise stated.

Prices for the Self Catered Property includes bed linen, towels, and cleaning of the property before and after your stay. The

advertised prices do not include, catering services, shopping packs, airport transfers, flights or travel costs; travel, holiday or medical insurance; lift passes; childcare; equipment hire or lessons.

In the case of advertised catered weeks, the price also includes daily breakfast and evening meals for 6 nights, plus a daily hotel- style cleaning service. The price does not include slope transfers.

CANCELLATION POLICY

In the event that you should wish to cancel your holiday, the group leader must notify us immediately. The following

cancellation charges shall apply dependant on when the notification is received:

Cancellation charge as % of total cost of holiday

More than 10 weeks before arrival date: Deposit

More than 8 weeks before arrival date: 20%

More than 6 weeks before arrival date: 40%

More than 4 weeks before arrival date: 60%

More than 2 weeks before arrival date: 80%

2 weeks or less before arrival date: 100%

Please note that for part cancellation of an exclusive use booking there is no refund due.

In the event of circumstances beyond Morzine-chalet.com’s control, should it be necessary for Morzine-chalet.com to cancel your booking, Morzine-chalet.com will contact the Group Leader as soon as possible. In this instance Morzine-chalet.com will endeavour to make alternative arrangements for accommodation (up to the same value) if available, or offer a full refund of any monies paid in relation to the booking. No other compensation will be offered. We cannot accept responsibility or pay compensation where the performance of our contractual obligations is prevented by or affected by events amounting to Force Majeure (Force Majeure meaning acts of war or threat of war, political unrest, terrorist activities, adverse weather conditions, volcanic ash clouds, strikes, acts of God, epidemics, riots, civil strife, industrial disputes, terrorist activity, natural or technical disasters, nuclear war) and or similar events out of our control.

CHANGES TO YOUR HOLIDAY

In the unlikely event that Morzine-chalet.com need to amend your holiday, we will undertake to let you know as soon as possible and will offer the altered holiday with an appropriate refund or the option for you to cancel the holiday with a complete refund of all monies paid to us. We cannot be responsible for refund of any costs incurred with parties other then ourselves.

In the event that you wish to amend your holiday in any way, we shall do our best to accommodate any changes although in the event that we cannot meet your request we reserve that right to treat the booking as cancelled.

INSURANCE

It is essential that all people in your booking have suitable travel insurance. You should be aware that not all travel insurance provides suitable cover for mountain activities. Please feel free to contact us if you require further information in this regard.

LIMITATION OF LIABILITY

LivMor does not accept any liability what so ever arising, or pay compensation for:

a. Any Force Majeure event.

i. Adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect any of these may

have on travel arrangements, accommodation and activities.

ii. Limitations imposed by resort authorities, ski lifts, ski school or ski hire operators.

iii. Travel arrangements made by the group or on behalf of the group.

b. Any personal injury or death, where so ever or howsoever arising, caused to any visitor and/or any member of the group for their duration of stay.

ARRIVAL & DEPARTURE TIMES

The property will be available from 15.00 on the day of arrival. Effort will be made to allow early access, if discussed with Morzine-chalet.com prior to arrival, however access cannot be guaranteed before 15:00.

For departure, the property must be vacated by 10am. Effort will be made to allow late checkout if possible and discussed with Morzine-chalet.com prior to departure day but this cannot be guaranteed due to changeover schedules. There is no luggage storage facility available and all cars must be removed from designated parking spaces.

RESPONSIBILITIES & BEHAVIOUR

Use of Morzine-chalet.com properties and supplied equipment is undertaken entirely at your own risk.

All guests to behave in such a way as to not prejudice our reputation, or cause any offence to our other clients, neighbours, suppliers, or anyone else associated with Morzine-chalet.com.

Excessive noise inside, outside or within the Self Catered Property, grounds or communal areas after 10pm will not be tolerated.

In the event of any infringement on this expectation, we reserve the right to terminate the contract with immediate effect and

demand you vacate the property. No compensation will be payable.

Under no circumstances are additional guests allowed to stay in the property other than those specified on the booking form.

Failure to comply with this may result in your booking being terminated immediately in resort and you and your party may be asked to vacate the property immediately. No compensation will be paid for this.

DAMAGES, BREAKAGES & ADDITIONAL CLEANING

We reserve the right to recover any costs incurred as a result of breakages, damage to the accommodation, or any other unexpected costs incurred by Morzine-chalet.com caused with or without intent by the customer. We do not accept liability for any loss or damage to property suffered by you unless caused by the negligence of our company. Any loss or damage, where so ever or howsoever caused; or arising by members of the group; to vehicles, property, grounds and outbuildings managed by Morzine-chalet.com must be paid for in full.

The holiday price includes an end of stay clean, however Morzine-chalet.com reserve the right to charge up to €150 Euros for additional cleaning if the following has not been adhered to before departure of a property:

All rubbish & recycling removed;

Removal of all food from cupboards and fridges;

Dishwasher on or emptied;

Bed linen stripped and left on the end of each bed;

Dirty towels to be left on a pile on the floor in the bathrooms

HOT TUB & SAUNAS

Morzine-chalet.com take hot tub & sauna care, cleanliness and maintenance seriously. Every week hot tubs & saunas are thoroughly cleaned & maintained. Guests use hot tubs & saunas at their own risk and special care should be taken at all times. Extra care should be taken during cold and icy conditions. Morzine-chalet.com presume that all guests, before using the hot tub & sauna, have read and understood the safety notices provided within the property. Children under the age of 12 years must be supervised and accompanied by an adult at all times to avoid the risk of drowning and/or overheating. Morzine-chalet.com reserve the right to close hot tubs & saunas for reasons related to, but not limited to, damage, chemical imbalance, breakdown, vandalism or unsafe conditions.

Prior notice is not necessary and in such cases compensation will not be payable to guests.

LOST AND STOLEN PROPERTY

Any client not properly securing the exits or windows of the property will be liable for any Morzine-chalet.com property stolen as a result of

that negligence. Morzine-chalet.com will not be held responsible for any theft or loss of personal possessions from the properties. Whilst Morzine-chalet.com will endeavour to ensure the security of guests’ personal possessions, it cannot be guaranteed. It is up to the group leader to ensure that each member of the group is responsible for the safety of all their own personal possessions, documents and equipment. No responsibility or liability is or will be accepted by Morzine-chalet.com in respect of such items. It is expected that all guests have taken out appropriate insurance to cover such loss and/or damage.

CHILDREN

No matter how much care is taken, our properties are not childproof. Morzine-chalet.com will not be held responsible for any accidents occurring within the properties, it is the parent’s responsibility to ensure their children are supervised at all times. Morzine-chalet.com can provide high chairs, travel cots and car seats for infants and babies. However, Morzine-chalet.com except no responsibility should an accident

or injury occur as a result of the use of such items. Parents assume full responsibility for the safety and wellbeing of their children at all times.

THIRD PARTY SUPPLIERS & ACTIVITIES

Morzine-chalet.com can assist in sourcing and booking many of the extra services you may need when on holiday, these services are subject to the terms and conditions of the individual third party companies. Our help in organising and recommending third party suppliers does not constitute an approval and Morzine-chalet.com take no responsibility or liability for third party services. Any grievance with a third party service should be taken up with that provider directly.

Airport Transfers:

Airport Transfers are not included in the cost of your self-catered holiday with Morzine-chalet.com. However, we can make recommendations or book your transfer to and from Geneva Airport. Where airport transfers have been booked, a small delay may be incurred in the event of incompatible flight times although we will endeavour to minimise any such delays should they occur. You and members of your booking travel in transfer vehicles entirely at your own risk. In the case of unforeseen circumstances, such as flight delays, cancellations, lost luggage, adverse weather and road conditions, you may be required to wait in the airport arrivals café area for a little longer, if this happens, you will be notified immediately upon arrival and kept informed of the situation. Morzine-chalet.com are not responsible for compensating any costs incurred due to unforeseen circumstances resulting in you missing your flight. Should you miss your flight due to inadequate pick up time, vehicle breakdown or accident on behalf of a transfer service, the transfer company will be responsible for providing a solution. Any additional costs incurred should be claimed against your holiday insurance. Morzine-chalet.com can help to provide you with any paperwork required to support such a claim.

Coaching, Instruction & Accompanied Activities:

Your booking contract includes no element of coaching & instruction. However, we can make recommendations or book your ski & snowboard lessons or guiding services. Any coaching or instruction received on your holiday from third parties forms no part of the booking contract. Morzine-chalet.com staff can provide advice on suggested routes and their difficulties but they are not qualified mountain guides and as such any undertaking by you of suggested routes or activities is done so entirely at your own risk.

PASSPORT AND VISAS

It is your responsibility to be in possession of a valid passport and/or any visa necessary. If you do not have a British or EC passport, please be sure to check visa requirements for the countries you will be visiting.

COMPLAINTS

In the event that you should have any complaints with your holiday you must inform the Morzine-chalet.com staff as soon as possible. In the event the complaint is not resolved to your satisfaction, you must confirm details of the complaint in writing to the address provided by the Morzine-chalet.com staff.

TERMS OF CONTRACT

All descriptions on the Morzine-chalet.com website are given in good faith and are believed to be correct. This is in relation to all aspects including activity pricing and information.

For the avoidance of doubt in the event of any conflict between the details on the website and the T&Cs the provisions of the

T&Cs prevail. The agreed contract is made in accordance with these terms and conditions.
